O-1B Processing Times

A common question that is asked is: Should I file my case regular processing, or should I file my case, premium processing?

Premium processing, you will get your case adjudicated faster, so you will get your response quicker, usually in about 3 weeks. The filing fee for premium processing is  $2,500. You can find more information here: https://www.uscis.gov/i-907.

Regular processing times are always changing and depend on case type and where the case is filed. You can check processing times here: https://egov.uscis.gov/processing-times/

However, very often the published processing times do not correspond with the actual processing times experienced by law firms and clients. Because the length of time a case takes to be processed if filed regular processing depends on time the case is filed, type of case filed, government backlog, and more.

Whether you choose to file regular processing or premium processing, it’s important to be strategic with your time and your petition. Do you want your approval to come in after your OPT expires? Do you want to know if you are approved before your OPT expires? Can you wait for your approval and not be employed during your grace period?
